Full Membership & Marketing Program Agreement Terms & Conditions

1. Referral Fees

Forex From Home.com (FFH) operates a worldwide referral programme via the Internet, giving members the chance to earn referral commission. FFH provides online education to trade the currency and futures market via the internet. All Members will be eligible to participate in FFH referral program and receive commission on the sale of course purchases. When friends or associates become Members of FFH via your unique ID number we'll pay you up to 50% of their purchase price. These commissions come direct from FFH as our way of saying "thank you". 

2. Definitions of an Affiliate / Sales Marketeer

Affiliates are members of FFH, as defined in section 3 below who have agreed to the Affiliate Policies and Procedures Agreement with the purpose of earning referral fees from customers they refer to FFH (Forex From Home Ltd.) Affiliates are members with a unique ID number supplied by FFH when they first join as a free member. All members of FFH can make referral income.  

3. Becoming an Full member / Affiliate

FULL Member / Affiliate: Any person can become a FULL PAYING Member of the daily FFH services. To do so you MUST register for free and supply a legitimate e-mail address. To become a full Member, you must complete the PAYMENT PROCESS on this site and join. This will also give you access to additional educational material. 
By signing into FFH and completing the membership registration process, you are indicating your agreement to be bound by the terms and conditions as set forth and posted in various policy statements of FFH including but not limited to FFH General Disclaimer. Once a member you can start making referrals and start earning referral commissions. ONLY FULL SUBSCRIBING MEMBERS can recieve maximum sales commission. An individual who does not pay the monthly subscription will not receive full marketing affiliate commissions. ONLY APPROVED and supplied marketing materials can be used to promote the FFH opportunity.

4. Individuals and Corporations, Tax Exempt Entities and Trusts

Forexfromhome.com will only accept, as members, individuals or entities that fall into one of the following categories: Individuals who are of legal age, unless authorised by legal parent or guardian. Corporations in good standing in the state or province of their incorporation

5. Members and Sales Affiliate Identifications

You may not use or submit to forexfromhome.com any e-mail other than your own e-mail address. This is so FFH can accurately contact you and keep clear and up to date records. Your details will never be sold to any 3rd party or company.

6. Proper Information

FFH will not be responsible for loss of referral fees due to:

FFH take all precautions necessary in making sure all commissions get paid to the correct affiliate member. What FFH can not be assured of is the marketeer directing a client to the correct site. This has to be the responsibility of the members and sales affiliates themselves.

7. Establishing Your FFH ID Number.

Once you have successfully registered on this site you become authorized as a sales marketing affiliate. You will automatically establish yourself an ID number. It will look something like this www.forexfromhome/123 
This site and number is hosted and maintained by FFH home office; although you can control access and certain features like the marketing tools. This is done in the member area. This area hosts ideas for effective marketing and driving traffic to your FFH portal. Once people arrive at you affiliate site portal they are encouraged to join FFH. On doing this, the client will always be registered to YOU via the code encrypted in the software behind the site. ALL online presentations are conducted by traders with trading knowledge, and conducted in an easy to understand manor to educate those interested in learning to trade Forex and Futures.

8. Ordering Courses and Subscriptions.

FFH are responsible for order processing and this is done via online merchant agreements using credit card facilities. FFH software will track all sales made by customers using coded links from your marketing ID number. All subscriptions are 4 weeks from the date you first joined and paid in advance. All course orders and subscriptions are paid via automated online credit card facility. Monthly subscriptions and automatically deducted unless otherwise stated.

9. Customer Guarantee.

There are NO GUARANTEES in trading PERIOD.
FFH teaches and promotes ethical principles and provides valuable information that prepares new clients to make educated trading decisions for themselves. The product is 'knowledge' including experience, research and analysis. FFH upload ' The Traders Diary ' so that clients can trade the market using their own money. Once a subscription is paid no refunds are given during that calendar month. To terminate the association a member simply requests to 'opt out' of the programme for the following month.

10. Referral Fees Definition.

FFH members who refer others are eligible to receive commission if their referrals purchase a course or full membership. See # 3 for actual definitions on commission payout. 

11. Accounting.

No accounting statement will be sent to you. You can access your account on line and print out your account status at anytime.

12. Policies and Pricing.

Individuals who purchase through this program are deemed to be customers of ForexFromHome Ltd. Accordingly, all FFH rules, policies, and operating procedures will apply to those customers. FFH reserve the right to change our policies, operating procedures, and prices at any time.

13. Return Policy.

FFH do not have a returns policy as there in nothing to return in the way of a physical product. Isn't that great, you never experience a 'claw back' on your commissions with FFH.

14. Errors or Questions.

You should notify FFH immediately of any errors or queries about disputable unpaid commissions. FFH will endeavour to correct any errors within a 30 day period. Any claim for reported errors after that time frame will have expired.

15. General Promotion.

You may ONLY promote FFH in a legal and ethical manner. All marketing materials supplied in the member area have been approved by FFH. All other new methods of promotion and marketing, including printed materials need to be approved by FFH. FFH will happily approve new promotional / advertising if it meets our marketiing code of conduct, therefore ALL artwork needs to be sent to FFH before going to press.

No aggressive or misleading practises will be tolerated. If a member or marketing affiliate actively promotes their site portal using spam or any other unethical manner then FFH will terminate that access and membership indefinitely. NO EXCEPTIONS.

Inner Circle Members (ICM) : These individuals can become more pro-active in marketing the FFH opportunity and in doing so will recieve higher sales commissions. ICM's can also help in the 30 new member programme. They can recieve up to $200 in extra commissions for this supporting role, this is paid by FFH direct, NOT THE CLIENT. NO OTHER FEES are permitted to be charged by acting ICM's without prior authorisation from FFH Head Office. ICM's agree to revoke all privilages and accept termination of their position should this rule be broken and it be found that extra charges to the client are being sourced. NO EXCEPTIONS

16. Limited Licence.

FFH grants you a non-exclusive, revocable right to use the forexfromhome.com logo and its associated software, banners, and/or buttons provided for linkage and such other images for which we grant express permission, solely for the purpose of identifying your portal site as our affiliate participant. You may not modify the banners, the message or any of our images in any way. We reserve all of our rights in the banners, the message, any other images, our trade names and trademarks and all other intellectual property rights. We may revoke your licence at any time with or without notice for violating this Agreement's rules, policies, protocols and procedures.

17. Responsibility For Your ID Number.

You will be solely responsible for the promotion of your FFH affiliate membership. You will hereby indemnify and hold FFH FREE from any and all claims, damages and expense (including without limitation, attorney's fees) relating to the development, operation, maintenance and contents of your ID site portal.

18. Unlimited Marketeers Per Household.

ALL individuals in a household (same address) may become an introducing marketeer and use the affiliate system to actively promote the FFH business. All family members will be treated as individual FFH members for the purpose of the Sales programme.

19. Conduct of Household Members / Sales Marketeers.

If you or any member of your Household engages in any activity which would violate any FFH policies and protocals, all household members will lose their FFH access and marketing rights. Keep your house in order !!

20. Inheritance of Referral Fees.

A member may inherit or bequeath their referral business to a relative of friend providing all transfer documentation is filed at FFH and policies adhered to by the new affiliate. This rule would mainly apply to Main Licence Affiliates.

21. Sale or Transfer of Referral Fees.

A FFH member may not sell, assign, license, or transfer any part of their FFH sales business.

22. Proprietary Information and Trade Secrets.

By becoming a FFH member and marketing affiliate you acknowledge that all actual trading information, including names, addresses and telephone numbers of other members and affiliates are FFH proprietary trade secret information. You agree not to disclose such information to any third party. You acknowledge that such proprietary information is of such character as to render it unique and that disclosure or use thereof is in violation of this provision and will result in reparable damage to FFH, which will be entitled to obtain injunctive relief and/or to recover damages.

23. Selling the FFH Product.

You may display or sell the FFH idea, concept and maketing programme by any and all ethical and practical means in order to capitalize your unique affiliate programme. See section 15 for promotional materials.

24. Media Inquires.

It is FFH policy to have a single spokesperson handling all inquiries from the media and all media relations. Due to the nature of our business and industry it is important to have such a measure in place. You may not, for any reason, act as a spokesperson for FFH nor talk to the media regarding FFH or its products or services. It is a direct violation of this policy to provide any information to the media, regardless of whether the information is positive or negative, accurate or inaccurate. All inquiries from the media must be referred to FFH directly.

25. International / National Marketing.

You are authorized and encouraged to refer potential FFH members world wide through your unique ID  website portal. You may NOT distribute your individual log-in details for others to use. This will violate your own membership privilege. If this is a valued service to yourself, then you understand that it will be a valued service to others and they will have to subscribe themselves. You may not, give, transfer, import, export or distribute FFH information, products or services, including Daily Trade Forecasts and Weekly Trade Commentaries, with anyone who is not a paying FFH member.
YOU can and should promote your sales ID number and web site portal freely around the world so as to receive the commission that you deserve for your leads that register for courses. Promote the system and the system will pay you for doing so. Forex Trading as an investment vehicle has NO BOUNDARIES, and has universal appeal.

29. Company Names, Trademark, Service Marks And Trade Name Restrictions.

You may not use, reproduce or disseminate the FFH name or logo or any FFH trademarks, service marks, or company names except in the use and dissemination of literature published and made available by FFH and with the written approval from FFH.

30. Restrictions on Advertising.

You are invited to promote your affiliate FFH website portal as much as possible. However all promotional and marketing initiatives must be ethical and not misleading to the end user - all avenues should be considered.
In the event of marketing initiatives, including; tradeshows; exhibitions; all marketing elements; electronic material and promotional merchandise, all needs to be approved by FFH.
Electronic material such as online multi-media, audio, e-mail bulletin boards, Internet communications and other online personal promotions are allowed providing all the above meet the ethics and our approval criteria. You may not use 'boiler room' tele-marketing approaches or out source such an activity to a company. You may display advertisement and or promotions, including, but not limited to, newspaper, magazine, radio or Internet sites. There are NO third party sales commissions payable via YOU out of your sales commissions. FFH will be exempt from paying such fees claimed by NON members.

31. Ethical Practices.

FFH members shall not:

• Engage in any deceptive, unlawful, unethical business or practice.
• Enrol minors or persons who are not capable of making an informed decision.
• Seek in any way to violate or circumvent FFH policies. To do so will meet with immediate termination.

Due to strict ethical codes put in place by the Securities Commissions it is imperative that all members and sales marketeers understand that NO TOLERANCE will be given to any misleading marketing / advertising used to gain a new member. Any sales member caught doing so will immediately lose all FFH membership and privileges... NO EXCEPTIONS.

32. Obligations of Affiliates.

As a FULL member of FFH it is your responsibility to:

• Abide by any and all federal, state, provincial, country and local laws, rules and regulations.
• Be solely responsible for declaration and payment of all local, state, provincial, federal and general taxes and fees as may accrue because of members activities in conjunction with his/her referral fees.

33. Sales Marketeers are Not Corporate Representatives.

You are not corporate representatives of FFH and are not authorized to incur any debt, expense or obligation on behalf of or for FFH nor bind FFH to any agreement or contract. You shall not, in any way, be associated with FFH other than as a Member or sales marketeer of the website. You are not considered an employee, agent or sales representative for FFH and are not allowed to represent the company in any form.

34. Waiver.

The failure or delay of FFH at any time to enforce any provision of the policies, rules and regulations will not affect the right of FFH to enforce such provision or to exercise any right, power or remedy hereunder.

35. Corrective Measures.

All of the policies and provisions in this Agreement are material terms accrued to by all members. If you violate any of the terms and conditions of this agreement, or if you commit any illegal, fraudulent, deceptive or unethical business conduct, FFH may choose one or more of the following corrective measures:

• Suspension of your membership for one or more months
• Cancellation of your membership.

FFH has the right to withhold commission fees during the period that FFH is investigating any alleged misconduct by you. If your membership is cancelled due to a violation preceding the investigation, you will not be entitled to any commission fees withheld by FFH during the investigation period.

37. Forfeiture of Rights to Referral Fees.

So long as you are in compliance with all policies and the terms of FFH, you will be paid commission fees in accordance with the pay plan. Your commission fees constitute the entire consideration for all of your efforts in referring customers, and your right to receive referral fees from FFH constitutes the entire value attributable to you. Following a resignation, cancellation, voluntary or involuntary, or death, the former member shall have no right, title, claim or interest to referral fees.

38. Terms of Agreement.

This agreement shall begin upon your acceptance of the agreement and continue for a period of 1 year unless either party gives written notice of intent to terminate. FFH reserves the right to alter the content, policy, procedure, and administrative flow of this agreement by posting revised guidelines or terms on this site. You may terminate this Agreement by notifying FFH if you disagree with said amendments.

39. Amendments to Referral Fees, Policies, and Procedures.

FFH may, at its sole discretion, amend its commission fees schedule by posting the amended schedule on its website in the members' area or by email notification. It is the responsibility and the burden of the Sales member to visit the me.mber area of the FFH website and get the up to date information on the referral fee schedule and any amendments thereof.

40. Disclaimer

By agreeing to this FFH agreement, you also acknowledge and agree to be concurrently bound by the FFH risk disclaimer. This is located at the bottom of the member area home page. FFH will use its best effort to maintain your site's functionality, however, technical difficulties may occur as a matter of fact and we will not be liable for the consequences of any such interruptions or errors.

41. Acknowledgement.

You acknowledge that you have read this agreement and agree to all its terms and conditions. You understand that we may at any time solicit customer referrals on terms that may differ from those contained in this agreement. You have independently evaluated the desirability of participating as an affiliate in the FFH Program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.
